During Monday’s meeting, the petition against Governor Babajide Sanwo-Olu filed by the Labour Party’s candidate for governor in Lagos State, Gbadebo Rhodes-Vivour, was unsuccessful.
According to information obtained by Naija News, the Tribunal’s hearing on Monday was delayed because the petitioners’ witness was not present.
It was discovered that the witness who testified in court earlier yesterday had to get medical help due to his health.
In Rhodes-Vivour’s petition to overturn Sanwo-Olu and his deputy’s victory, the witness whose testimony yesterday’s hearing was postponed would have been the petition’s eleventh witness.
Olumide Ayeni (SAN), the petitioner’s lead attorney, was not present at the hearings, but Idowu Benson, the attorney who handled his brief, informed the Tribunal that the witness arrived at the courthouse earlier than scheduled but had to leave when his health began to deteriorate just before the day’s proceedings began.
The council requested a brief postponement of the proceedings until the following day from the Tribunal.
He said, “The witness complained of feeling ill after waiting for some time and then excused himself by saying he needed to go to the hospital. We have informed the other counsel and craved their understanding.”
Meanwhile, counsel for the Independent National Electoral Commission (INEC), Eric Ogiegor; and Segun Ajibola, counsel representing Sanwo-Olu, and his deputy, Obafemi Hamzat did not object to the application for an adjournment
Morrison Quakers (SAN), the All Progressives Congress (APC)’s legal representative, also did not object because it was a medical matter.
Quakers said, “The witness of the Tribunal had a health challenge. If tomorrow (Tuesday) is convenient, we can come back tomorrow, except they have another witness.”
After hearing from each party’s submission, the Tribunal’s Chairman, Justice Ashom, adjourned the hearing until Tuesday, July 4, 2023.
